These Terms of Use and Privacy Policy (“Agreement”) govern your access to and use of the website located at passthecslb.com and any related content, services, or communications (collectively, the “Service”) operated by Pshichenko Enterprises Inc., a California corporation (“Company,” “we,” “us,” or “our”).
By accessing or using the Service in any way, you agree to be bound by this Agreement. If you do not agree, do not use the Service.
1. Educational Use Only — Not Professional Advice
All content on this Service — including audio episodes, written lessons, practice quiz questions, charts, and any other materials — is provided for exam preparation purposes only. It is based on publicly available study resources and is not a substitute for official CSLB or PSI Exams materials.
Nothing on this Service constitutes legal advice, professional engineering advice, contracting advice, or any other form of licensed professional guidance. We are not licensed contractors, attorneys, or engineers. You should always verify information against official California State License Board (CSLB) and PSI Exams publications before relying on it.
Exam content, passing standards, and testing requirements are set exclusively by PSI Exams and the CSLB and may change at any time without notice. We make no representation that our content is current, complete, or accurate. We cannot guarantee any exam outcome.
2. Non-Affiliation Disclaimer
Pass The CSLB is an independent educational publisher. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to the California State License Board (CSLB), PSI Exams, any California state agency, or any federal agency. Any use of their names is for descriptive reference only. All trademarks, service marks, and trade names belong to their respective owners.
3. AI-Generated Audio Content
Audio narration on this Service is generated using artificial intelligence text-to-speech technology. While we review content before publication, AI-generated audio may contain errors, mispronunciations, or inaccuracies. Content accuracy is not guaranteed. Always cross-reference with official CSLB study materials.
In compliance with applicable platform policies, all AI-generated audio content is disclosed as containing synthetic media.
4. Eligibility
The Service is intended solely for users who are 18 years of age or older. California contractor licensing itself requires applicants to be at least 18 years old. By using the Service, you represent and warrant that you are at least 18 years old. If you are under 18, you are not permitted to use the Service. We do not knowingly collect personal information from anyone under 18.
5. User Accounts & Google Sign-In
Certain features of the Service require you to sign in using your Google account. By signing in, you authorize us to collect your Google account email address and display name for the sole purposes of (a) saving your quiz progress and (b) sending you occasional study-related communications.
You are responsible for maintaining the confidentiality of your account. You agree to notify us immediately of any unauthorized use. We reserve the right to terminate accounts at our discretion.
6. Privacy & Data Collection
What We Collect
When you sign in, we collect: your email address, your Google display name, the date and time of sign-in, and your quiz progress data (scores, completion status per episode). We do not collect payment information, government IDs, or sensitive personal data through this Service.
How We Use It
We use your data to: save and display your quiz progress, send you occasional study tips and new episode announcements, and improve the Service. We do not use your data for targeted advertising. We do not sell, rent, or trade your personal information to any third party for monetary consideration.
Where It Is Stored
Your data is stored securely in Google Firebase (Firestore), hosted in the United States. Access is restricted to your account only. We use Firebase security rules to enforce this restriction.
Cookies & Tracking
We currently use no advertising or analytics cookies. Google Sign-In sets functional authentication cookies required for login to work. These cookies are strictly necessary and cannot be disabled without breaking authentication. We do not use third-party tracking pixels or behavioral advertising cookies.
Data Retention
We retain your account data for as long as your account is active or as needed to provide the Service. You may request deletion of your data at any time (see Your Rights below).
7. California Privacy Rights (CCPA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):
- Right to Know. You may request disclosure of the categories and specific pieces of personal information we have collected about you.
- Right to Delete. You may request that we delete personal information we have collected from you, subject to certain exceptions.
- Right to Correct. You may request correction of inaccurate personal information we hold about you.
- Right to Opt Out of Sale. We do not sell your personal information. You therefore have nothing to opt out of, but we state this explicitly for CCPA compliance.
- Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

8. Email Communications & CAN-SPAM Compliance
By creating an account, you consent to receive occasional email communications from us including new episode announcements and study tips. Every marketing email we send will include a clear and conspicuous unsubscribe link. You may opt out at any time by clicking that link or by contacting us directly.
In compliance with the CAN-SPAM Act, our physical mailing address is listed in Section 14 and will appear in every commercial email we send.
9. Intellectual Property
All original content on this Service — including but not limited to audio scripts, written lesson content, practice quiz questions, quiz explanations, charts, and graphics — is the exclusive intellectual property of Pshichenko Enterprises Inc. and is protected by United States copyright law.
All quiz questions are entirely original works created by us. They are not reproductions or derivatives of any PSI Exams, CSLB, or third-party copyrighted examination content.
You may not reproduce, distribute, republish, scrape, or create derivative works from any content on this Service without our prior written consent. Unauthorized use may result in legal action.
10. DMCA Copyright Policy
If you believe that content on this Service infringes your copyright, please send a written notice to the address in Section 14 that includes: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf; and (f) your physical or electronic signature.
We will respond to valid DMCA notices promptly. Counter-notices may be submitted in accordance with 17 U.S.C. § 512(g).
11. Paid Subscriptions
Certain features of the Service may in the future require a paid subscription. When paid subscriptions are available, the following terms will apply: subscriptions will auto-renew at the end of each billing period unless cancelled before the renewal date; prices are subject to change with at least 30 days advance notice; refunds are not provided for partial billing periods; you may cancel at any time through your account settings; cancellation takes effect at the end of the current paid period.
Payment processing is handled by Stripe, Inc. We do not store your payment card information on our servers.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
13. Limitation of Liability & Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PSHICHENKO ENTERPRISES INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO FAILURE TO PASS ANY EXAMINATION. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless Pshichenko Enterprises Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Service or your violation of this Agreement.
14. Dispute Resolution & Arbitration
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to this Agreement or the Service that cannot be resolved informally shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. The arbitration shall be conducted in Placer County, California, or via telephone or videoconference if mutually agreed. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You and the Company each waive any right to participate in a class action lawsuit or class-wide arbitration. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Jury Trial Waiver. You and the Company each waive any right to a jury trial for any dispute covered by this Agreement.
Small Claims Exception. Either party may bring an individual action in small claims court for disputes within that court’s jurisdiction.
This Agreement is governed by the laws of the State of California without regard to its conflict of law provisions.
15. General Provisions
Changes to This Agreement
We reserve the right to modify this Agreement at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Agreement. We encourage you to review this page periodically.
Severability
If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement
This Agreement constitutes the entire agreement between you and Pshichenko Enterprises Inc. with respect to the Service and supersedes all prior agreements, representations, and understandings.
No Waiver
Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.
